Filing for Divorce in Rockville

Rockville residents file for divorce directly at the Montgomery County Circuit Court at 50 Maryland Avenue. There is no extra step of going to a separate city court. The residency requirement in Maryland Family Law § 7-101 applies here as with any Maryland divorce: at least one spouse must have been a Maryland resident for at least six months before filing. Rockville's status as the county seat means the court that handles your case is the same court sitting in your city.

Maryland updated its divorce law on October 1, 2023. Under Family Law § 7-103, there are now three grounds: mutual consent, a 6-month separation, and irreconcilable differences. Mutual consent is the most popular option for uncontested cases. Both spouses sign a written settlement agreement covering all issues, and the court can grant the divorce without any waiting period. The 6-month separation ground applies when spouses have lived apart for at least six months. Irreconcilable differences can be raised immediately but may require a hearing if the parties don't agree on all terms.

Filing costs $165 without an attorney or $185 with one. After filing, your spouse must be served with the divorce papers. You can use the Montgomery County Sheriff, a licensed process server, or in some cases certified mail. The final divorce decree is permanently recorded by the circuit court clerk under Maryland Family Law § 7-106. That recording makes it a public record. All decrees are indexed in the Montgomery County case system and searchable through Maryland Judiciary Case Search.

A name change can be included in the divorce decree itself, or it can be requested in a separate court proceeding within 18 months of the final decree under Maryland Family Law § 7-105. Ask the clerk at the time you pick up your decree if you want to add a name change while the case is still active.

All court forms are free at mdcourts.gov/courtforms. Self-help guides are at mdcourts.gov/selfhelp, with a phone line at 410-260-1392. The legal help page for divorce is at mdcourts.gov/legalhelp/family/divorce.

Rockville residents can use the courthouse drop box any time, day or night, to submit forms and checks, which means you are not limited to business hours for document submissions.
