Carroll County Drop Box and Request Options
Carroll County offers a 24-hour drop box outside the Circuit Court office for people who can't submit requests in person during business hours. This is a useful option if you work during the day or need to submit a request on a weekend. The drop box is available every day, all day.
To use the drop box, write out your request on paper or print the Copy Request Form from the clerk's website. Put it in a sealed envelope and mark the outside clearly with "Family Department." Do not include payment in the drop box. After staff find your record and determine the cost, they will contact you to arrange payment. Once you pay, the copies are mailed to you. For faster delivery, include a self-addressed, prepaid return envelope with your request.
For mail requests, send the completed Copy Request Form to 55 N. Court Street, Westminster, MD 21157. Again, do not send payment until staff contact you with the amount owed. When they confirm the fee, you can pay by check made out to "Heather S. DeWees, Clerk." In-person visitors can pay by cash, money order, or credit card.
Note: The Carroll County clerk also has a Marriage Certificate Copy Request Form if you need a marriage record to accompany the divorce decree, which is sometimes required when updating legal documents after a divorce.
Carroll County Divorce Decree Copy Fees
Carroll County charges $5.00 per document for certification, plus $0.50 for each page copied. If you need an exemplified copy, which is a higher-level certification sometimes required for use in other states or countries, that costs $10.00 on top of the regular copy charges. These are standard rates used across most Maryland circuit courts.
Fee waivers are available for people who qualify based on income. Ask the clerk's office about the waiver process if the copy fees are a burden. The court will not refuse access to records based solely on an inability to pay if you qualify for a waiver.
The Maryland Division of Vital Records provides a lower-cost option if you just need to verify a divorce took place. For divorces recorded in Maryland since January 1, 1992, the Division charges $12 for a verification letter. That is not a full certified decree, but it can satisfy basic verification needs. Visit health.maryland.gov/vsa for that service.
For certified copies of older Carroll County divorces, the Maryland State Archives at 350 Rowe Blvd in Annapolis charges $25 per certified copy. You can also order through their online shop at shop.msa.maryland.gov. Call the Archives at 410-260-6400 if you have questions about whether a particular Carroll County record is in their collection.
Finding Carroll County Divorce Cases Online
The Maryland Judiciary Case Search is the free online tool for finding divorce case records in Carroll County. Go to casesearch.courts.state.md.us and search by the name of either party or by the case number. Divorce cases are listed with a "DA" designation for absolute divorce. The search results show filing dates, hearing dates, and case status.
Case Search does not let you read or download the actual decree text. It shows case-level information only. But it is a good first step. If you're trying to confirm that a divorce happened or find the case number before contacting the clerk, this is where to start. What a Carroll County Divorce Decree Includes
A divorce decree from Carroll County is the final court order ending the marriage. It is entered by a circuit court judge and kept permanently by the clerk's office as required by Family Law § 7-106. That statute requires every circuit court clerk in Maryland to permanently record and keep accessible all final divorce decrees. You can get a copy at any time in the future.
The decree includes the names of both parties, the date of marriage, and the date the divorce takes effect. It states the legal ground for the divorce. Maryland updated its divorce grounds as of October 1, 2023, and the law now allows for absolute divorce based on a 6-month separation, irreconcilable differences, or mutual consent under Family Law § 7-103. The ground used in a particular case depends on when it was filed and what the parties chose.
Property division is set out in the decree if there was marital property to divide. Custody and visitation for any children are also in the decree. Child support amounts and any alimony payments are included with terms. If either party asked for a name change and the court granted it, that appears in the decree as well. Under Family Law § 7-105, a name change can also be granted by the court up to 18 months after the final decree is entered.
Certified copies of a Carroll County divorce decree are accepted as legal proof of the divorce for purposes like updating a passport, changing your name on a Social Security card, or transferring title to shared property. Plain copies serve as reference but may not meet official requirements.
