Divorce Law and Garrett County
Garrett County divorces fall under the Maryland Family Law Article. Under Family Law § 7-101, you or your spouse must be a Maryland resident before you can file for divorce here. Garrett County is the right venue if either of you lives in Garrett County.
Maryland changed its divorce grounds in October 2023. Under Family Law § 7-103, the current grounds are a six-month separation, irreconcilable differences, and mutual consent. Mutual consent is often the fastest option. It requires a signed written settlement agreement covering all issues before you go to court. Irreconcilable differences can be used even without a long separation if both parties confirm the marriage has ended and there is no hope of reconciliation.

Under Family Law § 7-105, a party can ask to have a former name restored either in the final decree or by petition within 18 months of the divorce.
